 1. WHO COLLECTS PERSONAL DATA?

The company that collects personal data and implements data processing is:

Maison Balzac, a simplified joint-stock company with a capital of 37,800 Euros, registered with the Paris Trade and Companies Register under number 801 504 879, with its registered office located at 1 Cité du Paradis, 75010 Paris.

2.    FOR WHAT PURPOSES DOES BALZAC PARIS COLLECT PERSONAL DATA?

Balzac Paris is only authorized to use its customers' personal data if it has a valid legal basis.

Balzac Paris must ensure that it has one or more of the following legal bases:

  • the performance of a contract (e.g., to process and send an order or to open and manage a Balzac Paris account), or;
  • the fulfillment of a legal obligation (e.g., invoice retention), or;
  • when it is in the legitimate interest of Balzac Paris, or;
  • When the Customer has given their consent to data collection. 

The legitimate interest of Balzac Paris must not override the rights and freedoms of Customers. Examples of legitimate interests mentioned in the GDPR include fraud prevention, direct marketing, and data sharing within a group of companies.

4.    WHAT ARE THE RIGHTS REGARDING DATA?

4.1.   What rights can be exercised?

Each customer whose data has been collected has the right to exercise the following rights:

  • A right of rectification,
  • A right to object to the processing of their data and to the erasure of their data
  • A right to object to profiling
  • A right to restriction of processing,
  • A right to data portability 

The Client may issue directives regarding the retention, erasure, and communication of their personal data after their death. 

When Balzac Paris detects a personal data breach likely to result in a high risk to the Client's rights and freedoms, the Client will be informed of this breach as soon as possible.

The Client also has the right to withdraw their consent at any time. 

4.2.   How to exercise them?

These rights can be exercised with Balzac Paris, which collected the personal data, in the following way:

The request must include the last name, first name, postal address, email, and, if possible, the customer reference.

For a right of access to data, the request must be accompanied by proof of identity.

Balzac Paris will send a response within 1 month after the exercise of the right. In certain cases, due to the complexity of the request or the number of requests, this period may be extended by 2 months.


These rights may, in certain cases provided for by regulation, be subject to exceptions. 

In the event of no response or an unsatisfactory response, the data subject has the right to file a complaint with the data protection supervisory authority (the CNIL).

5.    TO WHOM IS THE DATA TRANSMITTED?

 

Your data is transmitted to Balzac Paris partners who may process the data on their own behalf (these are recipients) or solely on behalf of and according to the instructions of Balzac Paris (these are subcontractors).

5.1 Recipients of Balzac Paris data:

• AFFILAE, affiliation partner to identify the advertisement that redirected the customer to the site.
- Personal information collected by AFFILAE on its own behalf and on behalf of Balzac Paris in their capacity as joint data controllers, is intended to measure the performance of its advertising campaigns and to calculate the amount of commission for its affiliated partners. This information is kept in an active database for a period of 12 months, after which it will be deleted.
- The recorded information can only be communicated to AFFILAE's subcontractors and its affiliated partners to calculate the amount of their commission.

7.    HOW LONG IS THE DATA RETAINED? 

Balzac Paris has established precise rules regarding the retention period for Clients' personal data. In principle, data is kept for the period necessary to fulfill the purposes for which it was collected.

Unless otherwise required by law, Balzac Paris complies with the retention periods recommended by the CNIL.

The adopted retention periods are as follows:

  • Prospect data (individuals who have never purchased) is kept for 3 years after the last contact from the prospect.
  • Customer data is kept for 3 years from the date of the last purchase.
  • Audience measurement, targeted advertising, and social media sharing cookies are stored on the customer's device for a period of 13 months.

At the end of the retention period, the Client will receive an email informing them that, without action on their part, their account and personal data will be deleted.

8.    IS DATA ON MINORS UNDER 16 COLLECTED?

It is necessary to be 16 years old to create an account on the Balzac Paris website and make purchases.

Balzac Paris does not collect data on minors under 16 years of age, so any internet user under 16 years of age must refrain from creating an account.

9.    WHAT ARE THE RULES REGARDING COMMERCIAL PROSPECTION?

Balzac Paris uses your contact details to send you targeted advertisements, particularly by email, postal mail, SMS, on social networks, or third-party websites.

10. DOES BALZAC PARIS USE COOKIES, TAGS, AND TRACKERS?
